Welcome to Kash Marketplace. These terms are an agreement between you and Nellis Liquidation LLC, doing business as Kash Marketplace ("Kash", "we", "us"), and they govern your use of kashmp.com, app.kashmp.com, and the services offered there. By creating an account or using Kash, you agree to these terms. If you do not agree, do not use Kash.
1. What Kash is
Kash is a marketplace venue. Sellers list items and buyers purchase them from those sellers, not from Kash. We do not own, hold, inspect, or guarantee the items listed. Each sale is a contract between the buyer and the seller. We provide the tools: listings, search, messaging, checkout, and dispute support.
2. Accounts
- You must be at least 18 years old to use Kash.
- Give accurate information when you register and keep it current.
- You are responsible for what happens under your account. Keep your password private. Two factor authentication is available in your Security settings and we recommend turning it on.
- We can suspend or close accounts that break these terms, abuse other users, or create risk for the platform.
3. Buying and paying
Listings on Kash settle in one of two ways, and each listing shows which:
- Kash Pay checkout. You pay by card through our payment processor, Stripe. Kash collects the payment, deducts its fee, and forwards the seller's share. These orders are covered by our Refund and Return Policy.
- Direct payment listings. Some listings are marked "Direct payment". For those, the buyer and seller arrange payment between themselves and Kash never holds the money. We cannot refund what we never held, so use the same judgment you would use for any classified ad: inspect before you pay, meet in a public place, and do not send money to someone you do not trust.
When a seller accepts your offer on a listing, the accepted amount is the agreed price for that purchase. Offers and acceptances expire 48 hours after the offer was made, so complete checkout before then to keep the agreed price.
4. Selling and fees
- Listing an item is free to publish on every plan. Each plan includes a lifetime allowance of listings, shown on the pricing page. Every listing you have ever created counts toward it, including sold and archived ones, and creating more once the allowance is used requires an upgrade.
- When an item sells through Kash Pay, Kash charges the seller a final sale fee: a percentage of the sale price plus a fixed 30 cents, at the rate for the seller's plan shown on the pricing page at the time of sale. The fee is deducted before the payout, never billed separately.
- Paid seller plans are billed monthly through Stripe. You can cancel any time; the plan stays active until the end of the period you paid for. Fees on sales that already completed are not refunded when you cancel. Kash may grant promotional or complimentary plan access at its discretion.
- Payouts require identity verification with Stripe, our payment partner. Bank details and government identification go directly to Stripe; Kash never sees or stores them.
- Sellers are responsible for their listings being accurate, for owning what they sell, and for their own tax obligations.
5. What may not be sold
Listings are screened automatically. Clear violations are held before they ever publish; others are removed when detected, which may be after a listing has appeared briefly. The following are not allowed on Kash:
- Firearms, ammunition, explosives, and weapon parts
- Illegal drugs, prescription medication, and drug paraphernalia
- Counterfeit or replica goods sold as genuine
- Stolen property
- Recalled or hazardous products
- Adult content and services
- Live animals
- Government documents, IDs, and licenses
- Anything illegal to sell under applicable law
Repeated attempts to list prohibited items will close your account.
6. Messages between buyers and sellers
Kash messaging exists to arrange purchases. To protect both sides from scams, contact details shared in messages, such as phone numbers, email addresses, and links, are automatically redacted. Messages that trip our safety filters may be reviewed by our team. Repeatedly trying to move deals off the platform can limit or close your account.
7. Reviews and content
Reviews must reflect a real transaction and your honest experience. You keep ownership of the content you post, and you give Kash a license to display it as part of running the marketplace. We may remove content that is unlawful, deceptive, or abusive.
8. Advertising and featured placement
Some pages show ads: third party ads served by Google, and ads sold directly by Kash. Promoted listings on the homepage are always labeled "Sponsored", and directly sold ad units are labeled as such. Sellers can purchase an ad free add-on that removes ads from their own listing pages.
9. Referral program
Referral commissions, where offered, are paid out of the revenue Kash actually earns on the referred activity, at the rates shown in your Referrals dashboard. Commissions on orders that are refunded are voided.
10. Disclaimers and limits on liability
Kash is provided as is. To the fullest extent the law allows, we disclaim warranties of any kind, and we are not liable for the acts of buyers or sellers, the condition of items, or losses arising from transactions between users. For any claim, our total liability is limited to the greater of 100 dollars or the fees you paid Kash in the 12 months before the claim. Nothing in these terms limits liability that cannot lawfully be limited.
11. Disputes
If something goes wrong, contact us first at hello@kashmp.com or through the in app support center; most problems get solved there. These terms are governed by the laws of the State of Nevada, and disputes that cannot be resolved informally belong in the state or federal courts located in Clark County, Nevada.
12. Changes
We may update these terms as the platform evolves. When we make a material change we will update the date at the top of this page and give notice in the app. Continuing to use Kash after a change means you accept the updated terms.
